A Novel Question (for Scott or Linae): Settings and 4e

Scott and/or Linae,

I am currently working on a novel that involves the Nevemore campaign setting for the True20 system. If I choose to convert the campaign setting over to 4e and later the GSL is cancelled (such as when 5th edition comes out), then I would not be able to go back to OGL. However, I could create my own new rules system for the campaign setting at some future point with the same name and IP, but none of the 4e rules. Right?

In addition, is the restriction/removal of a race/class/monster, etc. considered defining, redefining, or altering the definition of the 4E Reference?

For example, could I say in a campaign setting's race chapter:

Instead of using the races in the D&D 4e Player's Handbook use the following races: Mortal, Feyblood, etc.

Alternatively, can we apply an "add-ons" to character creation system process such as "Background" or "Aspects"?

For example, could I say in a campaign setting book:

In addition, to a Race choose a Background.

In addition, to a Class choose an Aspect.

If not, then would it be fine to say:

As part of choosing a Race, choose one of the following Backgrounds as well.

As part of choosing a Class, choose one of the following Aspect as well.
