Why do you have to find OGL material to replicate such rules? You are still allowed to be creative in the OGL, after all. If there is a OGL material that is worded exactly like that of WotC, it would require WotC to either use the OGL or rely on copyright mechanismns to allow using wording, as I understand it.

Just because 4E introduces static defenses doesn't mean other games are no longer allowed to use them.
