The text of the flaming sphere suggest you sustain it with your minor action, and then steer it with your others (move - move it, standard - attack). The question is, is it legal to spend an action point to take an extra action with the sphere?

Another question regarding the sphere and other conjurations as well, can they be counted as allies for the purpose of flanking?

When you get a standard action from an action point you can spend it on whatever you want.

It doesn't count as an ally for flanking though.
