Combat Challenge question

I have a couple of questions regarding Combat Challenge.

1) Can a fighter mark an enemy using a ranged attack?

2) This question is more about the Marked condition really. Combat Challenge says: "While a target is marked, it takes a –2 penalty to attack rolls for any attack that doesn’t include you as a target."
If a creature is using a close burst 2 power (for example), and is using it againt 3 PCs (one of which is a fighter that marked the creature), does the creature take the -2 penalty for the other two attack rolls?? Or it doesn't since the power it is using already "include the fighter as a target"??
What if the power it was using had "One or two creatures" as Target??

Absolutely. Any attack roll, whether it hits or misses, marks an enemy. Many people like Dragonborn Fighters for this reason (1/encounter, Mark up to nine people at range). Keep in mind, of course, that most of a Fighter's stickiness relies on being within melee range of a marked target, however.

Any attack that includes the Fighter as a target takes no penalty. So a close burst, if the Fighter is in the area, takes no penalty (even against other people within the burst). I believe the other situation is debatable (I've wondered about it myself), but I'm fairly certain that if an attack has "one or two creatures" as the target, the Fighter is considered to be part of the attack. So neither attack would suffer a penalty.
