Hmmm it might be intentional I my part 
While there are a lots of armed people around, there are only two "guards" outside and three that were pushing the man in the arena. Depending on what the "patrons" do... well they seem to just be enjoying the blood... Then there is the pit master (fat dude) and Brother Kost...
And Evendur noticed a couple of people from the Broken Rutter who seem to have followed the group here...

From my perspective, the setup really seems to imply that there is no saving the guy. Or if we attempt to, it's a really bad idea considering we're trying to be discreet. I figure Oerth is a crappy enough place that good characters can definitely adopt the attitude that not everyone can be saved.

IC, from my perspective, the guy's a convict and deserves to die, so there's that, LOL.
