(Hopefully) easy question re: Sneak Attack

First Post
If a foe knows the rogue is there (at first) and neither is flat footed, but during the combat the rogue manages to Hide, can the Rogue then Sneak Attack the target even if it is NOT flat footed or flanked or denied his DEX AC bonus? i.e. The target is busy with the rest of the party. All this is assuming, of course, that the rogue has a missle weapon and is within 30' and a line of sight from their hiding place, etc. Where in the books or FAQs is this clarified? I am probably staring right at it and missing it

If the Rogue is hiden from the target, the target is considered to have lost his Dex to the Rogue. So, the sneak attack will happen.

Keep in mind that hiding after combat has started is not very easy. "If people are observing the character, even casually, the character can't hide." [SRD]

If the rogue can get out of line-of-sight, or make a successful bluff check to distract the opponent(s) ("Look! A purple worm!"), he or she might be able to hide.

The condition "the target is busy with the rest of the party" isn't quite sufficient, by itself.

This is true. I think Song and Silence has some information on this.

Right, I understand that. I just meant that the opponent had other things to do besides watch what the Rogue is up to.

I think this gives me the answer I was looking for. In summation: IF the Rogue can get out of sight (run behind a shed) -or distract the opponent with a Bluff ("Oh my gawd, what's THAT?!")- and make a successful Hide check, THEN the opponent loses his DEX bonus v. the Rogue's attack AND if the other conditions are met (within 30' etc.) THEN the Rogue can Sneak Attack the opponent.

Sound good? :D
