Revive and the death penalty.

So, the cleric used revive for the first time, and we started talking about whether you would have death penalty after being revived or it was only keyed to the Raise Dead ritual.

To move things along, I ruled no, but I couldn't remember if it was possible.

Anyone knows?

It doesn't look like there is any penalty from using it:

You call back an ally from the clutches of death.

Target: One bloodied or dying ally or a dead ally who died during this encounter
Effect: The target regains enough hit points to bring his or her current hit point total to his or her bloodied value. If the target is dead, he or she revives, then regains the hit points, and is considered not to have failed any death saving throws during this encounter.

The Raise Dead ritual specifically mentions the death penalty:

The subject returns with a death penalty: –1 to all attack rolls, skill checks, saving throws, and ability checks. This death penalty fades after the subject reaches three milestones.
 

This power is hardly unique. There are many ways in the game to reverse death or undo a character's dying that don't involve the Raise Dead ritual.

Most of them are Epic Destinies, but there does exist this precident.

None of them apply a death penalty, and all of them are 100% effective in their ways. The only method that mentions a death penalty, and the only place the death penalty is mentioned, is as a result of the Raise Dead ritual.

So, if you are un-deaded by means other than Raise Dead, you get no death penalty.
 


This is a result of exception-based design. There is no general rule specifying a death penalty - it is only mentioned in the Raise Dead ritual - which means it only applies to the Raise Dead ritual.
 

One thing to remember is that anyone can take the Ritual Caster feat and pick up the Raise Dead ritual. As such, it's supposed to be a bit of a last resort, and probably something that the party can find as a service in large cities and such. It has a penalty involved because it's a common means that anyone can employ with the right training. Kind of like how the Heal skill allows you to grant things like a saving throw, but at a much higher cost than some of the Leader powers specifically designed to allow such things.

Powers, on the other hand, are very different and require specific class, power and/or Epic Destiny selections. These have no penalty because it's a Cleric's job to have powers like Revive, in order to save the party's bacon. He can only do it once per day, but as long as he's alive he can save someone. Granted, if the Cleric drops....well, that's what Raise Dead is for!
