Only if Roy uses the command word. As he said in #295, the terms of the spell are, "One, he can't deal lethal damage to any creature within the bounds of any city, town, or village. Two, he can't ever be more than one mile from my position. And three, he can't piss me off too bad, because I have a command word that can activate it."

This situation would fall under the third condition, if any.
