Aura of Palpable Terror (Su): A darksider exudes can radiate a 20-foot-radius fear aura as a free action. A creature in the area must succeed on a DC x Will save or be affected as though by a fear spell (caster level xth). A creature that successfully saves cannot be affected again by the same darksider's aura for 24 hours. The save DC is Charisma-based.

Creatures within the aura also take xdx points of nonlethal damage each round they remain within the aura. A creature reduced to unconsciousness from nonlethal damage in this manner suffers xdx points of Wisdom drain.

Looks a good start. Shouldn't we add a rider that the victims perceive the nonlethal damage as coming from an attack (spell or weapon) by the darksider?

Creatures within the aura also take 2d6 points of nonlethal damage each round they remain within the aura. A creature reduced to unconsciousness from nonlethal damage in this manner suffers 1d2 points of Wisdom drain per round they remain within the aura. Victims perceive the damage as coming from an attack (spell or weapon) by the darksider.

Looks fine so far.

I'm wondering whether we should add some random "to hit" or Will save factor to each round's damage.

Also, 2d6 damage is feeble for an 8HD monster in 3E. We should consider increasing it. I'd go for around 4d6-6d6. Maybe with save for half?

Hold on, I don't like the Wisdom drain per round unconscious approach. I thought we were going for a Wis drain/damage each time they where "illusorily killed" (rendered unconscious), with the victims getting revived and "killed" repeatedly until they where "frightened to death".

Besides, if we switch to this approach how does the fear effect work on a target who's unconscious?
