So, making him an ally and having him use the item on their behalf is an option. Barring that, then yes, they would need to find a way to dispel the permanency if they choose to brute force it. Brute force is still an option, but it will require some additional leg work to find a way for a low level party to dispel a permanency then. I don't want to share the exact details of the campaign beyond how much I've already done so here, but I really don't think it would feel like railroading.
