If my character delays until after an enemy has finished physically attacking him with a sword and my character then tries to sunder the enemies sword which atk bonus does the enemy use - highest or lowest?.

On all opposed attack rolls the opponent always uses his highest attack bonus. This is true even if you try to sunder his weapon multiple times in one round (if your BAB allows multiple attacks). So even though your BAB will go down with each attack, the defenders will always be at the highest.

That's right. The defender will always use his highest BAB for opposed rolls, just the same as if he got an AoO after his turn in the round.
