They sort of rely on it.
So far, Everything Modern book (except past, which just came out) is in the MSRD or is OGL. They're probably going to continue that trend. Whereas only the core books, the psionics book, the epic book and the divine book have been SRDd. nothing from the races books or the complete books or the climate books or whatever have been made OGC. Because those books will sell well on their own. But because wizards can't afford to give enough support to modern on their own, they encourage third party suport through judicious use of OCG. It's not just that Shadow Chasers or Urban Arcana aren't important. Hell, Urban Arcana is getting it's own TV show.

So, yes, they're more lenient toward d20 Modern products. While they don't want anybody else to benefit from the established D&D brands (Forgotten Realms, Planescape, etc., and now Eberron), they wouldn't object that much to other people supporting the Modern settings that are not really as successful as their D&D settings are.
I wonder if that is hurting the d20 Modern line. But so far, there have been little expansion or additions of third-party publishers supporting d20 Modern, the most recent being the publisher of upcoming Dawning Star campaign setting.

D&D is the prize jewel, and truthfully, we let them know it. Meh.
