The text from Rokugan could probably be considered "Product Identity", but the rules and such aren't (as defined by the OGL itself). So IMHO at least, Rokugan can be borrowed from.

I don't have my Rokugan book here with me at work, but I remember combing through the PI/OGC section at the front a few years ago. IIRC, all of the classes in Rokugan which previously appeared in OA (samurai and shukenja) are not OCG by virtue of the fact that they appeared as closed content in OA. AEG had a special license with WotC to do the Rokugan book using rules from OA but that does not automatically make those two classes open.

Best to ask someone from AEG for clarification - Jim Pinto is here all the time in the "World's Largest Dungeon" thread.

That's why I'm still waiting for OA materal to be added to the SRD.

And yes, they have a special agreement, including AEG's use of the trademarked Oriental Adventures logo on all their Rokugan books.
