That Tower Shield ACP

Heya, question relating to a discussion our group is currently having, and that other groups have probably had before us.

Does a Tower Shield's Armor Check Penalty (a massive -10) apply only while it's wielded, or at all times while its being carried?

The group is split on which is the case. One half says it's big and unwieldy enough that the -10 should always apply, even if it's just strapped to the back whereas the other half say it should always apply only while it's in the wielder's hand.

The situation in particular that's coming up is whether or not it would impact the shield-wielder's ability to ride a mount. Note that the mount-riding wouldn't be geared as the main form of combat (but knowing GMs occasional mounted combat would be a possibility). If the penalty applies at all times we're basically changing our setup from "horse/other mounted travel" to "on foot" because the ACP is so ridiculously high that he'd never manage to stay on the horse.

ACP from a shield is only applied while in use.

That doesn't mean the shield doesn't add to encumbrance though. The weight of the shield adds to the total that is considered for encumbrance which can apply it's own penalties. (so it isn't disregarded, it is counted by weight).
