In the month of April, the publishers of YourGamesNow.com are giving away physical books for buying electronic product!

Each day in April, customers can qualify to win a free physical book. Each customer receives 1 chance for every $5 in product purchased in a given day. Then, starting April 2, we'll select a winner based on the sales of the previous day. If you checkout with $22 of e-product on Sunday, you have 4 chances when we draw a winner on Monday. (Purchases with e-checks will be counted on the day funds clear.)

Customers can qualify to win a physical book each day they shop in April. Winners will be notified through the e-mail address supplied by the customer's account, and books will be shipped to the physical address listed in the customer's account information.

How do you enter without purchasing a book? As tying a purchase to a chance to win something is illegal in most states.

A good point. I believe some publishers had this conversation elsewhere, didn't they? A couple of weeks ago. Now where did I hear this idea before....

That's an easy fix. Just add the phrase, "Void where prohibited by law". That should eliminate any legal issues.

I applaud the management of YourGamesNow for trying new ways to draw attention to the site and clients.

Actually, it doesn't.

This phrase does not eliminate a company's legal responsibilities. It is not a legal "cop out." It is a disclaimer. For example, let's say it was legal in PA to have a contest to award Twidgets to a winner, but Twidgets were illegal in NJ. If the ad ran on a Philadelphia TV station, the company would use the phrase Void Where Prohibited to alert consumers that there might be thnigs preventing them from entering. However, the company would still have to know WHERE the contest was prohibited in order to prevent residents of NJ from entering. It does not allow them to accept NJ entries and then just ignore them. And, if the company didn't do their homework and announced a NJ resident as the winner, they could be in a world of trouble.

That's true, but small companies tend to gloss over such things, relying on their small size , because realistically, state attorney generals have other things to do.

Agreed. I just called an attorney friend of mine that works in the Florida State Attorney's Office and (after a quick chuckle) he said the same thing. Compared to the things on their plate, this isn't something they're going to even give a blink to.

Having said that however, YourGamesNow should look into it just to cover themselves in case someone with way too much on their hands decides to make a stink about this.

I don't know about other states, but here (CA) the State AG has gone after many smaller, internet based businesses. After all the states consider themselves as being robbed by these business because of the no sales tax collected and paid to the state...

Besides...there is not much work for a state AG to do. If YGN does the contest as listed above they have broken the law. No way around it. The state AG sends a demand letter with a listed fine. If YGN chooses to fight then they go...but at YGN size the fine would probably close the doors. All it would take is one gamer to raise a stink with the AG, and a few hours for a clerk and jr lawyer to stamp out a demand letter.

You would think that YGN would a)not do anything illegal b)run the business like a business by consulting counsel and c)run a contest like a contest should be run.

I guess that means have it open only to purchases from states with a lottery.
