To do material based on other Tolkien's works like the Silmarilion, they need to talk to the Tolkien Estate, currently run by Christopher Tolkien, JRR's eldest son.

And apparently the Tolkien Estate is not the least bit interested in RPG licenses

Why not try support the Enworld Middle Earth d20 site.? I'm going to put together a game using the old MERP supplements and D&D rules.

Well for me, I prefer the new LotR game system over D20..but that being said, I really think the work at MED20 (hey that's a cool new moniker...MED-twenty..) is fantastic! I check it out fairy often.
