Bane's area is listed in the srd as "All enemies within 50 ft." as opposed to Bless's area of, "The caster and all allies within a 50-ft. burst, centered on the caster".

So is it a burst or an emanation or neither?

Or more to the point, does Bane affect enemies who enter the 50ft range after the time of casting? Or only enemies who are in the area of effect at the time of casting?

I would rule that it is a burst, and therefore it does not affect enemies who enter the area after the spell has been cast.

It's not specified, so using Bless as a baseline would be an acceptable choice. So, make it a burst, whereby only those within the area at the time of casting are affected by the spell for 1min/level.

Two votes for "Burst" then.

I think that was their intent as well, though doesn't a strict interpretation favor an emanation-like reading of the spell. If any other spell had an area and a duration wouldn't we rule it to affect anyone coming into the area any time during the duration?

Perhaps, but then you get to an even bigger problem. What happens when an enemy is within 50ft (saves or not), goes away and then comes back? Does he get a second save? SR is clear that it would be rolled only the first time, but a save is not so clear.

No, isn't it an instantaneous burst? Bang, you're tagged for the duration of the spell.

If we use Blade Barrier or Entangle as reference points then any one re-entering the area of effect would have to make new saves.

Since the last lines of both Bless and Bane say it counters and dispels the other, my ruling would be that Bane suffered from an editing oversight. It is supposed to be a burst in the manner of Bless.
