NO to the purchase DCs, the illegality of the poisons is included in the high price tag.
Are there no rules for collecting poison/poison making materials in the SRD? That's surprising. I guess this is something that we should take care of. I agree with Rystil, that gathering the materials seems too simple. But I don't want to over complicate the process either. I envision nightmarish "poisonous herb" and "creature" tables, with population percentages and difficulty to find, for each and every region in Enworld.
What if we left it up to individual DMs? They could determine whether the plant was appropriate for the area. Otherwise, I can't really see a way around detailing the poisonous plant life everywhere in Enworld. Besides just saying, "Mmm... k, I found some."
