3.5 Beholders, Mind Flayers, Yuan-tis...

The 3.5 SRD says:

The following items are designated Product Identity, as defined in Section 1(e) of the Open Game License Version 1.0a, and are subject to the conditions set forth in Section 7 of the OGL, and are not Open Content: [snip list of product identity FR, game & book names, and planes] beholder, gauth, carrion crawler, tanar’ri, baatezu, displacer beast, githyanki, githzerai, mind flayer, illithid, umber hulk, yuan-ti. All of the rest of the SRD is Open Game Content as described in Section 1(d) of the License.

The original SRD did not mention those specifically, but neither were they listed in the monster sections.

The exclusion of these monsters from the SRD is, as they say, the suck.

I'm sure there are myriad products that include mind flayers, beholders, and yuan-tis, not to mention tanar'ri, baatezu (see Legions of Hell) as monsters... how's that being worked out?

Goodman, Paradigm and Green Ronin all got permission (GR with their new Monsters of the Mind book) and WoTC, despite being burned in effigy, is usually pretty cool with such issues.

I don't think there are any Yugoloths in the SRD at all, are there? I didn't think they'd put any in the 3.5 MM, anyway. They're just in stuff like the MotP.

No, they aren't.
But if a publisher uses them in a product, it's ok for WotC?
 

You can have Neutral Evil Fiends, which people are using the old terminology for, Daemons or Deamons (forget which spelling). That's a term from mythology, so WoTC can't forbid that.

But if it's not in the SRD, it's not OGL, so you'll have to roll your own.

Mmm, you are right.
Daemon is the correct (latin) form.
