Are d20 Future aliens Open Conent?

I noticed that the alien races from d20 Future are not covered in the d20 Modern/Future SRD ( http://www.wizards.com/default.asp?x=d20/article/msrd ). Does that mean that they are not Open Content? If so, is there any way to use, or even reference them, or does one have to make up names that sound really similar but are not exactly the same?

Nope, can't use them. Basically because they're all from the Star*Drive setting or other ones that WotC owns and keeps as part of those settings' PI, just like shifters and warforged are Eberron PI and not OGC. And githyanki and githzerai, etc. as standard D&D PI.

Don't reference them. I think you could refer to them in the vaguest of terms, but slightly tweaking the name probably (?) wouldn't suffice. Vrusk might be referred to as "alien ant-men" or "insectoid xenomorphs" or whatever, but simply calling them Vursk or Vorks or whatever might not be okay. Maybe someone more knowledgeable about the subject can chime in though.
