This is not the DM being mean, it is the rules of the game.</p><p></p><p>Now they can still cast it at the end of the road before they approach his merchant, but that is really not the spontaneous sort of check you are talking about but rather a planned encounter in that case and the PCs should be allowed to "buff" for it.</p><p></p><p>2. Pick a lock - if you are in a dungeon, unlocking a chest after killing the BBEG, well this is exactly what the spell is designed for. There is nothing wrong with this. If you are trying to pick the lock on a door to the princess' room without alerting the guards at the end of the hall, well this is impossible if you cast the spell unless you use subtle spell (again this is RAW).</p><p></p><p>Note many of the cases above require subtle spell.
