Besides the dangers generally of relying on fair use, I don't see how he falls under the definitions provided by the guidelines, and (again, hearsay) he appears to be quite arrogant in his belief that he's right (ignoring what lawyers have told him), suggesting he's going to press this issue in court.So, in short, it looks like 1) he doesn't understand his own issue, 2) he's almost certainly in the wrong, and 3) he's going to fight it.
