Not only did the Sage say they can cast spells and have XP but WOTC have published an adventure in Dungeon #89 called "Headless" that used Simulacrums of the main antagonist which was a Necromancer-Loremaster and all four of them had up to 4th level spells to use against the PC in the adventure. Why would you limit a simulacrum from casting spells as the original (though reduced in caster level)? I assume you would allow a simuacrum of fighter to use the fighter feats and swing a sword? Or a Barbarian Simulacrum to rage? What would be the difference in allowing spellcasting by a Simulacrum? Just think of the adventure possibilities you lose out on by limiting that? "The PC's only thought they killed their enemy until he melted into snow. Now they have to worry where he is and will he attack while they are weakened after fighting his Sim?" Also keep in mind that Empower only increases the variable numeric effects by 50%. The variable here is 1d10%. You get 5% increase at most per empower used. 1 use and the spell is now 8th level, for 10% it is 10th, ect... for 100% (the maximum you should be able to get of someone) it would take a 22nd level spell slot using empower 7 times! Not possible except in the most EPIC of campaigns. As far a creating one of a god...those relics better be body parts of the god as per the Material components.
