There's no such thing as a Fortitude modifier. Do you mean Constitution?
Petrification is a very rare effect, but I guess +5 is a substantial bonus.
It may be better to have earth swim replace a utility power rather than an encounter one.

Again, I think you mean Constitution rather than Fortitude. You need to specify what attack roll is required, and against which defence. You also need to have this power increase in attack bonus and damage as the character levels (c.f. the dragonborn's breath) because there's no bonus from implements.
 

The Earth Swim (assuming it is not also a Tunneling power) should work like Phasing (and other abilities) and specify that the character must end the movement in an unoccupied square.

And, imho, the damage from the Fire Warping (Warding?) seems to be very high. Perhaps something more akin to the damage of a Dragonborn breath (1d6+Con Modifier)? Especially if that damage is automatic (I would recommend requiring an attack roll).
