I have truly no idea how you'd ready anything I've written as "WOTC would be a bad actor and force Darlene to court? Almost blaming them for it?" It's not me in the weeds here. It sounds like you're inserting emotions where there are zero. Generic Company A threatens lawsuit against Generic Company B. In the process of publicly discussing said lawsuit they mention Witness A as having some baring on the support for their case. Generic Company B wishes to defend their IP rights. Generic Company A then drops their lawsuit requesting dismissal without prejudice for fear they will lose their IP rights if they lose the case. Generic Company B, facing ongoing uncertainty concerning said IP rights unless they can achieve a dismissal with prejudice, files for declaratory relief stating they are the sole owner of the IP rights. Generic Company B, by necessity of Generic Company A having previously mentioned Witness A as part of the cause for doubt about the rights, will call Witness A for a deposition to clarify that aspect of the case. That's it. No bad actor. No "forcing" and no "blame" this is just ordinary legal litigation issues. Once NuTSR mentioned her by name, they may have forced her to be involved even if they change their mind later. Once you name someone has having information pertinent to the matter lawyers become obligated to investigate it further no matter how people "feel" about it. If they wanted Darlene not involved in the case, they should not have mentioned Darlene in connection to the case. At this point I suspect the toothpaste is out of the bottle. And I don't blame WOTC for that at all. It's just how this stuff works.
