Dungeon Magazine Magic Items

In our game we can buy magic items that we can afford to have made for us.

And also potions.

Can we buy magic items that are also in the Dungeon Magazine, or are these magic items specific to a particular game module and not meant to be avaliable for purchase outside of that game.

Its just that they have full magic item stats and purchase price and level on them.

There is one consumable that lets you spend a surge but then you cant shift for the rest of the battle, I think thats quite a cool item to be used only in desperate situations and could be funny / dangerouse if you used it too early.

The basic rule is this: Ask your DM. :)

All items from Dungeon Magazine and Dragon Magazine (and any other official source) is potentially available for purchase and/or creation. However, many DMs prefer to keep the list of available items small and additional source items are distributed as rewards. I think the technical term for it in D&D is "loot".

So, there's no reason that you couldn't get that item; just ask your DM first!

Generally the 'official' rules is that anything available in your campaign setting exists in your campaign setting. It would not automatically be allowed, for instance, to take "Cannith Goggles" in Forgotten Realms as the Realms don't have a House Cannith.

That said, any buy/sell is by DM Fiat: they may say that a given item is only available in certain large trade ports, or they may say that the item is available only at thrice normal price. The only items you're 'entitled' to in most cases are the 4 magic items per party per level given as treasure. Whether you can spend the rest of the money on magic items is up in the air.

Dragon Magazine, particularly, is completely legal: it's considered just as legal as the player's handbook according to official sources, although a given DM may ban certain sources outright (everything from "original three books only" to "everything you can think of" is possible)

My personal thought is: If it's a) available in eberron and b) in the character builder or should be in the character builder, then my players can get it somewhere, even if only in Sharn.
 

Whereas stuff like a Horreb Cube is adventure specific and should never show up again.

Even if someone is crazy enough to write it into Living Forgotten Realms :)
