Level Up (A5E) Flumph not in WOTC SRD but is in ENP SRD

Just noticed this. Considering that EN Publishing made a point of steering clear of things like the Beholder or Mindflayers, I'm curious as to the justification here.

Flumphs are in Pathfinder too so I don't reckon they're protected IP like Beholders or Mindflayers.

The justification is that the flumph was one of the monsters that WotC allowed Necromancer Games to put in the Tome of Horrors, releasing them as Open Game Content.
