Frost worm

OK here is the scoop, our party was fighting this creature it was upped to gargantuan size. Our DM said it was 32 hit dice and was wondering if that was correct . The Main problem was trying to figure out the creatures death throes .

Original stats for Frost Worm (MM p 111)
Huge magical beast
14HD (BAB +14, Saves 9/9/6)
Natural armor +10
STR 26, DEX 10, CON 20, INT 2, WIS 11, CHAR 11,
breath weapon 15D6 COLD :eek: ( REFLEX for half DC22, CON-based )
death throes 12d6 cold/ 8d6 piercing :eek: ( REFLEX for half DC22, CON-based )
advancement: 15-21 (huge); 22-42 (gargantuan)

DM figured formula for the saves is 10 + 1/2 HD + Stat MOD

Modified stats
32HD (BAB +32, saves F18/R18/W10)
Size increase (per MM p. 291)
huge to gargantuan: STR+8,CON+4, NATURAL ARMOR +4, -2 AC/ATK
new stats:
Natural armor + 14
STR 34, CON 24
Breath weapon DC improves to 33
Death throes DC improves to 33

DM claims that he add hoc'd thee amount of damage Death Throes dealt
based on creatures % of HD.

12d/14d=0.85 for cold... or 27d6 @32HD
8d/14d=0.57 for piercing... or 18d6 @32HD

This mod went unchallenged, resulting in two character deaths (as orchestrated) but after the dice rolled he felt the result was wrong (too high an amount of damage put out)

The question: What is the correct damage out put of a gargantuan Frost Worm.

Side note does the piercing damage being dealt count as magical other side note being a silver dragon shaman and having immune to cold do i take 1.5 damage from fire based attacks I'm saying no but the DM is saying yes.

Size does not increase the Death Throes damages, only the saving throw.

A 32 HD Frost Worm would look like this:

Gargantuan Magical Beast
32 HD
HP 400 (32d10+224)
Init: +4
Speed: 30', Burrow 10'
AC: 20, FF 20, Touch 6
BA: 32, Grapple 56
Attack: Bite +41 - 4d8+18
Space/Reach: 20'/15'
Fort 25, Ref 18, Will 12
Abilities: Str 34, Dex 10, Con 24, Int 2, Wis 11, Cha 11 (+5 distributed anywhere for HD increase)
Skills: Hide/Listen/Spot 11

Trill's DC is 26.
Breath weapon is 33.
Death Throes 26.

The Death Throes ability deals 12d6 Cold (energy damage) and 8d6 Piercing (physical damage).
I don't believe Dragon Shaman are weak to their opposing energy type, as they do not gain the energy subtype usually attributed to those with weaknesses.

The DM is correct that cold immunity goes hand in hand with fire vulnerability, regardless if a Subtype was or was not applied.

Cold Immunity
A creature with cold immunity never takes cold damage. It has vulnerability to fire, which means it takes half again as much (+50%) damage as normal from fire, regardless of whether a saving throw is allowed, or if the save is a success or failure.

Cold Subtype
A creature with the cold subtype has immunity to cold. It has vulnerability to fire, which means it takes half again as much (+50%) damage as normal from fire, regardless of whether a saving throw is allowed, or if the save is a success or failure.

I don't see silver dragons taking more fire damage than the norm . From the monster manual , the only thing i see is chromatic dragons taking the extra damage. Not the metal dragons. And again the Class would say if i took more damage than the norm if it applied . Which it does not remember Immunity to cold is an EX ability my creature type does not change. I'm still Human.
