If I am not using something(say the SRD), then I am not deriving anything from it. The game mechanics in the Epic Level Handbook from my example under copyright law are public domain. I can create my own work based on those game mechanics, I even pointed out that the problem in doing so was making sure not to step on their copyright. Derivative work doesnt even apply in this case.
