The only way to beat him down(figuratively) is to make up a list of DM rules and hand a copy to each player. The guardsman(we assume) would find both pc's very suspicious and would ask more questions down at the local pokey. Have the pcs actions have real consequences (and that is a rule that should be in your player handout from up above).
