improved familiar question

If I get an improved familiar at 5th level (wizard), that familiar gets all the listed abilities for a 5th level master, right? By listed abilities, I mean intelligence and natural armor boosts, as well as the more special abilities like touch and speak with master.

The reason I ask is that the DM I am playing with thinks that since I wasn't able to get this familiar until 5th, I should treat it as if I was a level 1 wizard and proceed from there. That makes no sense to me, but I wanted to get some second opinions.

It doesn't seem to be that clear. I allow the familar to gain the abilities of a 5th level Wizard to keep things easy.
