If the player does spend the daily, the other orc <em>is</em> half a foot to the left, and in-game, the ranger thinks "I'll never get a better chance!", and takes his double-shot at both of them.</p><p></p><p>So your question is "What happens if they line up right, but the rules don't allow you to the use the power?"
