IANAL (I rarely get to use that bit of netspeak :D ) BUT, I do work in and around them and cases similar to this all the time. More than likely, once Torm & Co. retain counsel and such, this will go quickly and easily. That has little to do with the offending driver's culpability and much more to do with the extent of the injuries. If one or more people in the car was seriously hurt (or, God forbid, killed) then the insurance company would be looking at shelling out hundreds of thousands if not millions of dollars. That's the sort of thing that they're going to involve their lawyers in bigtime. They'll dig and dig for any little bit of responsibility of Torm, the owner of the vehicle he was driving, the vehicle's manufacturer, anybody. However, with the prospect of no serious hospital bills to pay and only having to pony up the cost of replacing a used, totalled vehicle, I'm willing to bet that they just write the check and then drop the drunk from their coverage. And, by the way, a big shout out to TogaMario who I've not gotten a chance to see in many a Game Day. Hope you can make it again sometime!
