D&D 5E (2014) Multiple Creature with Lair Actions

Sunday I used an enemy that, despite only being CR 5, had Lair Actions. The CR calculations made it seem like I could use a trio of them for my game, but really quickly I realized that 2 of them plus the Lair Actions was already pretty tough. Afterwards, discussing the encounter a few questions came up:

Are Lair Actions taken into account for a creature's CR?

Should multiple creatures with Lair Actions have their own set of them? Maybe not with the multiples of the same type, but what about two different creatures?

I'm wondering about the fairness (and ethics!) of a monster without a set lair being teamed up with a weaker monster that has one.

Which leads to this- is there something inherently special about a creature with Lair actions, or are these merely suggestions, and any creature could have them? When I first encountered the concept, I remember something in 3.5 about dragons having a corrupting effect on their environment which created hazards, and thought this was a similar concept, that some creatures just spawned random magical effects. But now I'm thinking about a Kobold lair where random traps go off every turn.
