Multiple Questions

Okay, so here are a few questions that have come up in the past couple of sessions with my group. Thanks for any help in clearing these up.

1) Ghosts are Ethereal creatures. They have the ability to Manifest into the Material Plane. This is an ability that only they possess correct? Someone who is Ethereal doesn't have any similar ability to manifest, right?

2) Could a Rogue who was avoiding looking directly at a creature with a Gaze attack Sneak Attack the creature?

3) What are the penalties for not looking directly at a creature? Are there any? The MM doesn't mention any, but then you only get a 50% chance of avoiding the the Gaze attack.

4) Would a spellcaster who was drained several levels (and thus lost the entire highest level of spells) regain them upon being Restored? (ie, would they get their spells back for the day, or would they stay gone?)

I think I have other questions, but honestly, I can't remember. So any help you could provide on these is much appreciated. Thanks! :D

1) a character that has the ability to go Ethereal either is ethereal or isn't. Manifestation allows a ghost to be in an in-between phase to affect the material world

[edit - a ghost's manifestation ability is specified in the Ethereal section in the DMG (p76)]

2) averting your eyes to a gaze attack gives the gazer one-half concealment, and closing your eyes, total concealment (DMG p77). a rogue can't sneak attack an opponent with concealment (PH 47-8)

3) see above :)

4) if i understand correctly, no, they would not get their spells back. victims of an energy drain lose their spells, they don't gain a penalty to their spells (DMG 75). Restoration removes the penalties from an energy drain and only restores 'level functions' (PH 246), as in the ability to learn/cast/memorize those spells, not the spells themselves. (i think ;) )
