OGL - Mixing Versions

We know that the 4E fighter is going to be based on the Martial Adept and it is a reasonable guess that 4E will have Swift Actions as part of the base system. So assuming that it is referenced correctly on the back licence page, is there any reason why someone can't produce a product for 3.X that takes advantage of these and other things that WotC created for their system after the last SRD was released?

Unknown until WotC gets around to releasing the 4E SRD and OGL (if different). Presumably it could be done with anything in the 4E SRD. However, they could have a 4E OGL (or an OGL called something other than the OGL) that is more restrictive. I think that's a long shot, though.

Book of 9 Swords. The Fighter classes in there get the equivent of spells (called maneuvers). They increase in power and damage output as these classes go up in level.
 

Do note that Swift and Immediate actions are part of the current SRD (they're under the Psionics portion somewhere), if those are what you might be looking for.
