Originally posted by Bastoche: Actually, to my knowledge, the videotape belongs to the kid who publicized it. According to Waxy.org: "Originally recorded onto an 8mm tape on November 4, 2002 in the school's studio, the video was never meant to be seen by anyone. After Ghyslain returned the borrowed videotape to his friend, the video sat in a basement for months. On April 19, 2003, Ghyslain's friend stumbled on the tape's secret contents and immediately shared it with friends. They thought it would be a funny prank to encode the video and upload it to Kazaa." Technically, no legal case could be made in that regard. He has no say in the matter. Distributed without permission? Probably- I doubt Ghislain explicitly allowed it. But since the tape was the property of the kid who distributed it, there is no copyright violation. This strikes me as being very similar to the South Park where the boys film Cartman in his backyard having a tea party with his dolls. Cartman was stupid enough to do something in a public place, and someone filmed him. Same thing here- this kid recorded himself on a non-secure video device, and when he forgot about it and someone else found it, he was careless. Finally, on the mental illness thing- this may sound heartless, but a normal person would not be sent to a psychiatric institution over something like this. Yes, it might cause some anxiety, but psychiatric institutions exist to medicate people who already have existing brain abnormalities and the problems associated with them. In those cases, its only a matter of time and circumstances until something tips the person over the edge, and they need biochemical help. I honestly do feel sorry for the kid, but no one could have known that he would get this messed up over it. However, a lawsuit against the parents of the kids who distributed the video is simply spiteful. The parents of the other children had nothing to do with the video being distributed, and the kids in question have no way to pay back that kind of money. This strikes me as just another way to freeload off other people- and I find that despicable. I DO think it would be cool for him to be in Episode III- after all- during that entire video, the kid never hits himself with the pole. That takes talent (which I don't have).
