Questions about getting pinned down

1) When you return to somewhere you were getting pinned down, would it be better to keep your current pinned penalty or to revert to your old one? The old one might make more sense flavorwise, but much more hassle bookkeeping wise.

2) Should you only get pinned down if your enemy is actively attacking you? I feel like it should only go up each turn you're attacked, but the rules as-is have it go up every turn. There's not much difference in the average fight, but I'm imagining something like enemies coming in waves or an enemy being temporarily disabled.

1) Would it be better? Excellent question! Playtest it and let me know! (Although I must confess I didn't quite grasp what you meant there).

2) Yes, as you're attacked is appropriate. That was the intention; thanks for spotting the error!
