Spell for leeching Dexterity?

I'm interested in making a spell that would let you make a touch attack to deal 1d4+1 points of Dexterity damage and gain that many points of temporary Dexterity for yourself.

What level should this spell be? Have there been other spells like it published (and if so, are they OGC)?

Frostburn has a 1st-level spell called lesser shivering touch that deals 1d6 points of Dexterity damage on a melee touch attack. Ability damage is seldom a good idea in my view because it stacks with subsequent castings, unlike a penalty, and ability score points increase slowly with level, if at all.

The classic leeching spell is, of course, vampiric touch. If the spell imposes a penalty instead of dealing ability damage, and grants the increase as an enhancement bonus, I might peg it at the same level, 3rd. If it does ability damage or grants an unnamed bonus, I might bump it one level for each enhancement.

That's pretty powerful. At the very least, I'd recommend that the temporary Dex points that the caster gains cannot stack with Cat's Grace or any item that grants a similar bonus.

What level should this spell be? Have there been other spells like it published (and if so, are they OGC)?

Haven't thought about it too much. I'll start the ball rolling by saying 5th level. I haven't seen any OGC spell that's similar, but then I don't have much 3rd-party stuff.
