Statistics Block Question

Can I print a statistics block for a monster that is of a different level? For example the MM lists a Level 13 Elite Controller Githzerai Zerth. Can I reprint the statistic block if I edited to be at Level 10? I can only assume no but can just print the new bonuses, HP, defenses, but not the effect of the Githzerai's attack?

Also, from what I read of the GSL, it's ok to print our own original monsters and NPCs? What if we want to use an existing monster attack and just add it to a new monster or NPC?

Githzerai and Zerth are not in the SRD, so you can't use the terms or any derivation of their stat block in a licenced product. Refer to clause 9.1:

Supposing the Githzerai Zerth was listed in the SRD, you couldn't print a stat block for it, altered or not, but you could include a derived stat block called something else (say, Githzerai Sophomore).

If you use an existing monster attack listed in the SRD, you can't reprint the description of the attack. I think you could show its basic stats that vary by monster (attack, defense, damage) and refer to the appropriate WotC rulebook title for its special rules.
