Both Joel and Marlene are guilty of that crime (depriving her of her agency).But the kicker is that when Marlene told Joel that 'Ellie would have wanted this' even Joel clearly seems to silently agree with her (as do you above). He knows it's what she would have wanted, but he doesnt care because he refuses to lose her. He doesnt care he dooms the world, because he refuses to lose her.
