Use Magic Device question

Suppose a non-evil Rogue finds and intelligence, evil sword. He tries to emulate alignment so he can wield it as if he were evil. He fails. I have two questions:

1. Could he retry the check? The guys I play with say 'no' because it's intelligent, so it would recognize the Rogue the next time around and know he's not evil, regardless.

2. If he succeeds, how often does he have to make the check? Every time he tries to use the weapon? If you make it once with an item (say an evil Robe of the Archmagi), do you never have to do it again?

I'm not sure, but I think one would roll UMD each time they used it. So, roll each time one draws the sword, and each time one wears the robe.
 

1) Yes, he can retry it. Retries are fine with UMD except if you roll a 1, in which case you can't retry for a day. The intelligence of the sword may be a factor if your DM wishes it, of course.

2) I'd rule that you need to emulate alignment every time you try to use the sword. If you're emulating alignment "in an ongoing manner...you need to make the relevant emulation checks once an hour", so that's what you'd need to do with a robe of the archmagi.
