What happens if you don't fulfill a gaes?

Ok, here is the deal, one of the PCs made a deal with an evil cleric to find a group of cultists. The only condition is that he bring back one of the cultists alive and unharmed (not literally,but no missing limbs or tortured or anything like that).

Now, here is the glitch, the party took on a deal like this about 3 levels ago and it ended particularly badly, namely the person they were supposed to bring back alive was killed. So, the evil priest wants a guarantee that the PC will do his best to ensure this cultists safe return, so he insists on a gaes spell for the man's safe return.

So here is my question, what happens if the cultists does get killed? Does the PC take 3d6 points of damage every morning forever? Does he have to try and bring the guy back to life or else the curse kicks in for good? What if he tries to get the man raised from the dead and decides to stay dead, then what?

1) It's not forever; it's 1 day/level or until discharged (Geas inherits the duration from Lesser Geas - take a look).
2) You don't have to succeed to avoid the effects - you merely have to try to succeed (again, this is spelled out in the text of the spells).
