Where is the line between surprise round and not?

Do you simply roll higher inititive?

Is it if one member of the party gets into charge range without being noticed?

Is it only during *special* times (rarely).

I'm running KotS tonight and the rogue wants to know *sigh*.

Same as in 3.x. The enemy is unaware of your approach, usually from a Stealth vs. Perception opposed check.
 

It's exactly the same as in 3E. The only difference is that you're no longer counted as flat-footed after the surprise round.

But rogues can still smack you if they attack you before you act.

Yeah. I think it was the passive perception skill of the most perceptive kobold. Whether you use passive or an active roll for perception would depend on the circumstances. Is the enemy expecting someone to pass by soon? Use active rolls. Are they just there, completely oblivious to the fact that someone is walking up on them? Use passive perception as a stealth DC.
