From the get go, Zweihänder was not a true retroclone¹... it's earliest versions were taking and hybridizing WFRP 1 and WFRP2 (which are significantly different approaches mechanically), and then adapting that hybrid to play well. I've never gotten it to table, but I have a copy of the core. I have a bunch of acquaintances who love it, tho'. For me, tho', most of what it took from 1e is what I'd rather have seen from 2e, and most of what was from 2e, I'd rather have the 1e, save the multiple skill levels. As for the legality and ethics - game mechanics are unprotected under US law, and with good reason: protecting them stifles innovation. The literal text can be, but not the mode of play, nor the how and what to roll when, and what that means. As for the ethics: neither source game was in print, and WFRP 3 was so different, that Zweihänder wasn't really competing with WFRP 3, only with the used market for WFRP 2. I don't see any ethical problem there. Plus, not all of it was taken from WFRP... some outside influences hit, too. To be honest, when it comes to "intended to feel like WFRP", Warlock is more my speed.

1: Pedantic note on Retroclones ... OSRIC - that's a true retroclone - it was recreating all the mechanics in paraphrase. Except for the monk. Very few of the so-called retroclone OSR games are actually retroclones. Dark Dungeons is a true retroclone of the D&D Cyclopedia and the mechanics from Wrath of the Immortals. Several others started as true retroclones, but later moved away from that role.
