Constitution damage options?

Ok gents, to keep this from getting too "Arrowhawk-y" or "Visigani vs Dandu" or any other sort of drama, how about RAW to justify that a limitation exists or a specific interpretation is reasonably valid?

Because, if no RAW reason exists, in the 3.x editions, that they cannot stack, it falls under DM call territory, and outside the OP questions.

It's not drain, it's a penalty. Old Harm is a terrible analogy, it's nothing at all like durational penalty to hit points, it's an instantaneous reduction to 1d4.

And I don't smoke anything, perhaps you should consider quitting. :)
I agree that Harm was a bad analogy, in that the damage didn't come back.

Can you cite a source of ability damage that describes it as a "penalty", or uses some language that amounts to "suppression" of the ability score? There being more than one method, it's quite possible that I've missed that language somewhere.
 

The Shadow Hand capstone maneuver deals ability damage, but has a duration of 1 minute...

Make of that what you will (I make of it poor editing, which is a problem throughout the Bo9S).
