Pretty much pro forma to move for dismissal in any criminal trial, no? Seems to be so up here, whether or not the motion has a hope in hell. I was a witness in a case that involved a computer store owner acting as a fence for stolen gear and not only did he move to have the charges dismissed at the beginning, he also moved to have the conviction set aside at the end of things.

Yeah, I can't see how saying "I'll just shoot him Friday" and then bring guns with you will help your case that you're just joking. It's like saying you're gonna blow up an airport and bring a bomb with you.
