It looks like he should have actually, willing going gaseous isn't supposed to grant immunity to magic weapon damage and it should make Durkula's AC much worse, but the author now chucks out the game assumptions as convenient. Sure he can do as he wants, but this is like a mystery writer who keeps making outlandish twists so the audience can't make educated guesses based on the evidence at hand.

Vamp Durkon is of an equal class level to Roy, but you have to add additional benefits from being a vampire which gives him a clear edge. Plus, Vamp Durkon needs to survive this in order to fulfill the dwarven clan prophecy hinted about him.

Actually, he should be ahead - Roy previously mentioned that he'd only just caught up the level he lost when he died. Durkon doesn't (yet) have that problem.
