Not sure what RAI was, but I would just add "may" to the spell. If you don't have a spellcasting ability, or if your strength/dexterity are higher than your spellcasting ability, just use the normal modifier for the weapon attack.
Given the effects, it wouldn't really create a power concern.

You couldn't Power Attack. Basically you either do or do not have Advantage/Disadvantage. Saying having them both "cancels them out" is a bit inaccurate - their effects cancel each other, but you still have the condition. It's why you can't stack advantage.
