Im seeing all this complaining that the old system was hard on GMs... just how many NPCs are you stating up anyhow? I have found that 99% of the prep work done on an NPC is ignored anyway.

didnt sound hostile to me. As a layman, looking at precidents (like the monopoloy case) I have always thought you didnt need their permission, except in the cases of trademarks and patents, since you cannot copyright a system.

I only do that on games that are out of print, and then only if I can get them cheap enough... Adventure!, Warahmmer FRP (1st edition), Cyberpunk 2020... I never buy multiples of new books, if my players want a copy they can buy it themselves

where does it say that?
I can agree that, from that point on, you get the bonus. I cannot agree that you get all the hit points you didnt get bacause your CON was too low to get the bonus.
ie at 8th level your con goes from 17-18 you shouldnt get an additional 8 hit points
